ICE has published an expanded list of science, technology, engineering and math (STEM) programs that qualify students seeking a 27 month post-studies employment authorization card rather than the usual 12 month card. I have a peculiar situation where my wife wants to apply for H1 and work after being on H4 for the last 3 years . My son who is currently on H4 wants to convert to F1 to pursue his studies . My doubt is whether I can still include them in my GC application at 485 stage whenever it happens although they were in H4 when the GC Process started.
Any suggestion / advice is highly appreciated.

How do I post to the monthly contest and keep the pictures in my albums? If I copy the images it posts them again in the "today's photos". Is there a way to post to just your album without them going to "today's photos"?

Hi Gurus:
My wife got H1B approved in this year cap with validity date from October 1 2009. She is going to India for vacation during August 2009 and planning to go for H1B stamping.
My question is, whether she can go for stamping before October 1, 2009 which is the start date mentioned in I797 or she should go for stamping only after October 1,2009 ??

I have an approved I797 from last year qouta. I got a 221g when I went to stamping for my H1 visa. The 221g was regarding some documents which the employer had to provide. Subsequently I obtained a L2 visa and I am now in the US. I would now like to apply for a change of status to H1.In this regard I had the following question:
On my L2 I have applied for a EAD about 3 weeks ago. USCIS says that it could take upto 90 days to approve the same.During this time if I apply for a COS to H1, would it influence the decision making on the L2-EAD approval or they are completely separate processes?

I was curious if somebody has experience of H1b stamping in dominican republic?
I am planning to go there on a business trip, is it advisable to just go and get it stamped there or should I rather go to canada/mexico and get H1 stamped.
I looked at their website but it's not really very helpful.

Hi,

Later on I got L1-A visa from my company A in Feb 2008 and came to USA on L1-A visa in Feb2008 and working for comany A till date on L1 visa.
Now I want to change my status from L1A to H1-B to join company C .
My H1 petition is valid till 2010 October. My questions are
1. Can I change my status from L1A to H1B any time before October 2010(H1b expiry date).
if not, How many months before I need to change from L1 to H1b before my H1b petition expires.
2. My current project is still ongoing till October,2010 and I am with L1 status. so Can I wait till October and then apply for change of status to join new company C on H1-B visa.
Need your help.
