To pbojja, your post shows how you may have completely misconstrued my post. I haven't written the post out of frustration of not being EB-1/2 at all. And am I dreaming when I hear you say that good English speaking skills aren't important in the U.S? Maybe I am in another world. I said clearly that the 'fraud' desi firms and their employees have tarnished India's image. They should be removed from the system and we should be in line with 'genuine' cases. What's wrong with that? Where's the unfairness here?

Write to USCIS simple explanation and show a proof such as HR letter stating your presence on active payroll continusly for all the term and run it through attorney, if you have. Else put together logically framed chronologically ordered history. Attach W2's for the years and demonstrate un-broken timeline.
If their is nothing to hid or falsify, ... don't worry about anything. Good news is your case is active. People here ( no offense to anyone) will split hairs trying to answer simple issue. Keep it simple and truthfull and nothing adverse will happen.

I received Card Production Ordered email today for my EAD renewal. I hope I get the EAD for 2 years. Will keep you guys posted on the EAD validity once I get it.
I got the same email this morning and status said EAD was ordered on june 30th.
I am pretty sure we will get a 2yr EAD but will just have to wait 2 more days to confirm this.... I wonder if they are looking at the current status and if you are on h1b they are issued 1yr and processed it before june 30, while if you are currently on EAD, they kept them until June 30th.. I doubt it but just a theory...

Fragomen took about 6 months in getting "prevailing wage info" for my case in 2001. My manager ( Canadian who had gone through US GC process himself) finally talked to them and asked them to file without waiting for DOL's reply on prevailing wage. (That was a risk but we agreed to take it at that point)
That six months delay costed me 6 years in GC processing ! But thanks to my manager , otherwise I dont know how many more years I would have waited.(One of my co-worker still awaits his labor cert !)
The big law firm goes by predefined steps , which are probably the safest way for most cases but may not be the fastest way. You need somebody who has been through this process and can understand and asks good questions to lawyers and can help lawyers to think for your perticular case. Check if you have somebody in your org to do that.

I then contacted them 3 weeks after that day and they said they have established the requirement and will request the DOL for prevailing wage info (this was 2 weeks ago). My last and final update to this post. I got my original Green Card (Cards not green color) It was the happiest day, the wait was finally over the air smelled a little better.
My two cents - Have patience explore other means of getting green card if one doesn't work. An attorney once told me there are soo many ways and regulationsto get green card that half of them are not even in law manuals only the old timers know about them. Enjoy life life with green card and with out it is the same.but the time you spend never comes back. If you have problems with your employer just imagine if you didn't have a job. So make the best of your time and enjoy this great land which we call america.

Please contribute - let's not make IV plead for contributions, t's ridiculous. This is a thankless job IV is doing - and as the main post says "Consider yourself part of something big. What we are doing is something big." The process is so horribly long and demeaning that people may even become terminally ill during the process! This is no time for lethargy - get off your big behinds and start acknowledging the mess we're in - the anti-immigrant forces want to squeeze every ounce of blood & sweat out of you before you get your due, if at all and you cant not just afford to keep quiet!

Excellent idea!! Senior citizens are quite active politically and many of them are more mature given their age & experience. We should certainly take this one up...

Thumb-up for the DC Rally! I think our efforts will be long-term. We got to get the idea across to as many people as possible. Rally is powerful, but we also need to use other types of campaign--big or small to get our voice heard.
One idea my American friend shared with me was to make presentations at retirement centers or community centers/ events. We need to be visible and our contribution to the country made known.

Just a question, why is everyone so happy that the CIR has Failed and more importantly why does everyone on here feel that if CIR is resurrected it will "haunt" us?
If CIR fails to go into "production" this year, is it not true that we have ZERO reform? I mean would it not be better to ride this wave and try and sneak our provisions into the mix rather than SIMPLY feeling happy that CIR is "dead"?
At this point (even after the PD movement), About 70% of us are still in the retrogression mess and will continue to be in that mess till SOME immigration reform passes. So the question then is: Should we not be trying and praying that CIR passes WITH our provisions (and i know how hard the core team is working and hence i am asking this question). I mean the core team has given an infinite amount of time and energy to this project. Would it not be easier to see a bill finally pass and try and get our provisions in this bill rather than killing this bill?
Just a thought - I feel that sometimes it is worth losing a battle to win a war.
Having ridden this wave thus far, and knowing now how hard it is to get favorable amendments into this bill, I am finding myself siding with those who think it best if this bill dies. And we probably have better chances of attaching our items to other appropriations bills etc.
However I am a 100% behind IV core, whatever course they take.

Hello,
We are on same boat too.Looking for options to file I-485 without receipt number.Our lawyer insisted that we can not file I-485 without receipt number.
We spoke with employer to let us know if they can see cancelled checks online.People who have applied in early july ,can you please let us know how many days it took to get the checks..

I gave all my signed I485/G28/I325/I765/I131/693/Photos forms by June 8th. They filed mine on June 27th. They reviewed it for 17 days.
They never attend email or calls. Hope mine gets accepted.
I sent my documents to them on June 10th and due to my persistent push they mailed on June 19th . But general responses are more than decent.

Right now the anti immigration folks are not even ready to raise H1 quota by 10K . Imagine if some one asked them to allow H4 visa holders to work that is straight 100K - 300K more people in market plus least 40K added every year. How much ever I like or support your feelings its next to impossible to get any one to support this. I guess most H4 are already aware that they will not be able to work in USA. They can use the time creatively to get higher education or apply for H1.
Why doesnt US govt allow H4 Visa holders to work like Australian Govt does??????
Rather than crying for shortage of Manpower they should utilize the talent already present in the country. Has someone every raised this issue with the senate? I dont think so....and I think there is no forum also to take it up.
This is a pure case of discrimination.

I have been laid off yesterday. My employment ends Dec.
My 180 days expire Jan. My company said they will not revoke the I-140.
So can anyone explain the steps that needs to be taken by company B after they transfer my h1, for time period Dec thru Jan.
Can I use ac21 afterwards? and
Can myself or my wife work on the EAD that will come to our home address?.
What else needs to be done by company B.

I was in Indian consulate for renewing the passport. I went there on time and there was a pathetic guy at the entrance who refuse to speak other than hindi. Though I told him that I do not understand hindi, he never listen to that and started his conversation with hindi.
Then comes the worst part. A cab driver went to him and handed over some dollar note and got the token. Then the driver handed over the token to the passenger and left. That guy got into the line well before me and got his work done. @#$K those people.

I had the same question so I asked my attorney and he told me that you can "transfer" your H1B after Oct 1 and benefit from AC21, meaning that as soon as company B files an H1B petition for you and you have proof of this filing, you can start working for them.
However, I understand that you want to "transfer" before Oct 1, in which case company B has to file a new H1B petition either regular or with premium processing. This new H1B is not counted against the cap because you have already been counted against the gap in the 6 previous years.
In short, you should be able to work for company B starting Oct 1 if they file for a new H1B now and it is approved by Oct 1.
I recommend you ask an attorney for your specific case.

Same here ... for EAD and AP (for me or dependent) my company does not reimburse these fees. They will however reimburse if I have to use EAD to work due to unavoidable H1 extension issues/ inability to extend beyond 6 yrs etc. I think that is a fair and reasonable policy in general
I know they charge a lot, but my employer will pay them higher fees but my employer will not pay me filing fees.
