I don't think uscis can do that. They can either accept applications or reject them. If they hold the applications for next 3 months, they would violate their long-term procedures and would fear a lawsuit because of that. They know that they are original documents in those applications that can be used once again...god knows when...

I filed I-140/I-485 April 22 and received receipt notices. No appointment letter for finger printing yet and no LUDs. Texas currently processing date is April 28 for EAD. Sould I be worried?
If you e-filed and no FP notice then you won't be getting EAD in 90 days.
The day you get FP notice from that at least two weeks after FP will be scheduled. After FP it takes 2 weeks to further processed (Card + approval).
Although USCIS says to contact after 90 days, you should think in terms of getting infopass.
Could anyone else provide some more input?

Skills in general are typically formed by three components:
a) 1/3 - Formal hands-on Training
b) 1/3 - On the job experience
c) 1/3 - Reading, research on your own
If you have some indirect project experience by working as a programmer for example, I don't see why not you cannot do items a) and c) above. At least the PMP (or whatever certification you intend to take) will be ready when opportunities come and the training should help you expand your horizons. Good luck.

About the funds .. you know the answer and logiclife videos tells exactly the same. But you said I know nothing about the funds. What exactly you are looking for. Money spend on each event? i think they started doing it. Recently pappu mentioned they need 41k for the rally.. I think we are improving on that front ..

Is there anyway we can work on reporting fraud desi consulting companies to the USCIS so the fraud EB applications can be cleaned up from the system? That may help in clearing up the backlog. These desi firms have sponsored people in EB-2 successfully. I have worked with these IT 'professionals' who can't speak a word of English and hardly have any idea what's going around them. I am serious, this should be considered and evaluated. No offence meant to anyone but those who have had a wonderful educational background and don't work for desi 'firms' ought not to worry since this doesn't target them at all. Thanks.

Insulting TheOmbudsman it's just not acceptable, I though we were all H1B educated people who are open to discussion, not just a child crying and insulting as soon as someone contradicts you.
I know many people who stopped comming to this forum (contributing), they just get tired of those insults. If someone has a different opinion, is immediately insulted

Hi,
Here is our situation. I am on H1 and have 485 pending for me and my wife. Both of us also have a valid EAD.
My wife was on H1 too, however since Oct'08 she relinquished her H1 status and took up another job using her EAD. Currently, we are planning to have her AP filed (her earlier AP expired in Dec'08).
Given all this, I have following questions.
a). Are there any risks associated with filing AP.
b). I presume her status has been valid so far... reason I ask is that we didn't do anything special in terms of communicating any official agency, when she jumped the boat from H1 to EAD. Were we supposed to?
c). Do you think I can get her on H4 while she continues to work using her EAD. I guess H4 option is more expensive? Any thoughts?

These news are common when anyone is in politics. When some one get sudden familiarity other group try to spoil the name. First they tried that her 5th child is not her child but her daughter's child. She immediately announced that her daughter is 5 months pregenant. After that they started that she has immoral relationship. It may be or may not be true. But until it becomes true she may be considered as good wife and Mother.She is inexperienced that is true but if we consider that Obama also inexperienced. So it is just selecton of better evil. But Politicians here is much better transparency,less corrupt,better skilled than majority of countries in the World.
Just to add, Not sure if this is true but there is news that Sarah Palin cheated on her husband, and had a relationship with the business partner of her husband. She is not a good mother, not a good wife, cunning & opportunist politician, with very little experience and a heartbeat away from her finger on the nuclear button when she is ready to go to war with Russia. Yes, USCIS IS capable of processing quickly (for example, my own case - but I'd say I was very VERY lucky, rather than an indication of system wide improvements). Remember, my GC was approved whilst my PD was not current, and I am still baffled why this happened. Having talked to many people about it, there is a strong suspicion of "squeaky wheel" helping.
Neah, there were too many approved to be all squeaky wheels. I think I know what they did. On July 1st they ran a simple query and picked up every application that has had no outstanding RFEs and had cleared namecheck, and then assigned them a visa number. If your receipt is from June, you may have cleared namecheck by July 1st, so you got the number. The rest (fingerprint check and approval itself) is just technicality.
I am on the opposite spectrum of the processing - been pending since early 2006 in EB2 ROW. My namecheck cleared late August - guess what, I am still waiting, perhaps until new numbers become available in October (even though I am current). Even though I have been waiting longer, they really finished working on my petition in June of 2006, so everything on the CIS side, including an RFE was done in 4 months. So, I really do not think your case is an exception. Most current approvable petitions that are not stuck in namecheck are approved in 3-4 months. So, in my opinion, quotas are the main culpit. Namecheck is easier to tackle because it gets a lot of bad publicity from delayed naturalization cases.

The Chinese market was/is in urgent demand for US-trained financial analyst. After some interviews, I got a very generous offer from a multinational company and quitted my job in US without any hesitation.
Now five years has passed. Because of my excellent performance, I get two promotions in the past five years and am a director in my company. My boss, who is an american, lost his job and has to go back to US because my company cannot see any fiancial advantage to hire him anymore. I have never been happier. I believe that I made a very good choice five years ago. Most of my chinese classmates during MBA study are still struggling for their GCs and get stuck in their career development because of GCs. They are quite regret that they did not come back to China back 5 years.
So what I want say is that, US is not a very good place to stay anymore. There are many golden opportunities in your own country! Many countries are becoming stronger and stronger. It's not 10 or 20 years ago. 10 or 20 years ago, US is the best place in the world to stay. But now, it's different. My friends in US make about $150k a year and cannot afford a luxury lifestyle. I make $100k a year and enjoy a very comfortable life in China. I built my own house in China, which is even better than my house in New Jersey before. I hired my own chauffeur, housekeeper, two nannies for my baby... I cannot afford these thing if I were still in US. How many americans can afford the same lifestyle as mine? I don't think there are many.
My point is, be open to opportunities in your own countries or other countries in the world other than US. You will be happy to leave US several years later when you look back. Besides, if more and more US-trained scientists and professionals come back to their own countries and help their countries to develop, maybe in another 10 or 20 years, no one would want GC anymore."

If I were you, I would make it clear to the employer that you qualify for tier 1 in UK and educate them on benefits of tier 1 vs waiting for green card then go from there. It worked for me.
My plan was to see if I can upgrade to EB2 with the same employer. My attorney just shut my hopes down this afternoon. Per my attorney, the job description has to differ by atleast 50% if I were upgrade from EB3 to EB2 with the same employer. I guess it is hard to prove that Principal Software Engineer's job description and Software Engineer's job descriptions differ that much.
At this point I have not other option but to wait it out. I cannot move to a new employer and refile in EB2 because of valid reasons.
