    Hi,

    I applied SSN 3 week back and planning to go to India for 2 months due to personnel reasons. I am not yet received my SSN.
    Is there any problem, If I go to India before getting SSN ?

    Please reply me. Its very urgent for me. Thanks in advance.

    While taking a VISA appointment , there is a question which says "Are you applying for same visa class that expired in the last 12 months?"

    Here are my doubts

    1. I had a H1 B VISA which expired in May 2007 processed by my previous employer. As I am applying for the same VISA class , but though a differnt employer, should the answer be 'YES'?

    2. Since my daughter will be appearing for the H4 VISA interview for the FIRST TIME, Is she also eligible to come along with me if I choose "YES" to the question "Are you applying for same visa class that expired in the last 12 months?".

    My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.

    Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

    Hi,
    I was working for a telecom company. I passed 6 years and then was on 1 year extension. Meanwhile my I140 was approved. Lately i was given pink slip and then transfer my H1 to another company. i couldn't join the company since i was waiting for approval notice for my H1 Transfer. Today i received the denial notice for my H1 transfer and extension. I called to the lawyer and they told me to file for B2 as they haven't received the notice as of yet. So the reason of denial is still unknown. I was wondering what are my current options? Should i wait and file a motion for the H1 transfer denial or should i go ahead with B2? Please advise.

    I have a peculiar situation where my wife wants to apply for H1 and work after being on H4 for the last 3 years . My son who is currently on H4 wants to convert to F1 to pursue his studies . My doubt is whether I can still include them in my GC application at 485 stage whenever it happens although they were in H4 when the GC Process started.

    Any suggestion / advice is highly appreciated.

    Just need some suggestion:

    I may be on the chopping block next week..
    currently am on my 8th year H1, expires march 2010..so less than a year to restart..and be back in the line. (spouse on H1)

    My 140 is pending...

    so if i lose my job.. can i go to H4.. even though i have stayed here for more than 6 years..
    and in case if i get job ...can i get back on H1 and restart GC?

    i am thinking.. i have come to the end of all options.. and the only course available for me is back to desh..any inputs..will be appretiated..

    I did my MBA in one of the premium universities in USA.
    I applied for H1-B in FY 2008 under master quota from a small consulting company.
    I left US on 30th Sep 2008 as I didnt get an approved petition by that time.Hence I never worked on that approved H1-B petition
    I got a approved petition. I went to New Delhi consulate for H1-B stamping. However I got a Blue 221 G slip. I never submitted any document as the consultant who applied for my visa , needs lots of time to process the documents. In the mean time I got another offer from one of the fortune 500 companies in USA. I am just exploring the possibility of H1-B transfer in this case. Ofcourse they will file a new H1-B application but would I be cap-exempt in this case?
    Please help!!

    The time spent in H4 does NOT count towards the 6 year H1 time. So in your case the H1 clock starts from Sep 2004.

    Yes, you can track EAD online. All you need is case number. EAD will come to applicant address.

    I have got an RFE for my I-485 application. . I missed to complete a question (part3 and question #10) in I-485 form for which I got a request for evidence letter from USCIS. Can anyone has any template on how i should reply. Your help is much appreciated . Thanks in advance

    You did not properly complete part 3 question 10 of your form I-485 applicatio.
    Question # 10: Are you under a final order of Civil Penalty for violating section 274C of the immigration and Nationality Act for use of
    fraudulent documents or by fraud or willful misrepresentation of a material fact, ever sought to procure, or procured, a visa, other documentation, entry into the United States or any immigration benefit.

    Therefor submit an affidavit with your answer to this question a 'Yes' or 'No' response.
