Hi All,
I need some advise on my situation.
I am working in India and my H1B visa has been approved to work with a client in the NJ area. After the visa approval and before the stamping, my employer has asked me to go and work with a different client in the NY area (as my original client project got canceled). So, the client and the location are changing.
So, I will be going for my H1B visa stamping with a client letter and location different from what is in the petition. Is that OK or is it a sure shot denial case?
Do I need a new LCA or H1B amendment? My employer is not keen on doing them, and thinks that it should not be risky to go with the existing paper work.
Please give me some advise.

The right hand box has a important message. Which states that a Indian citizen is Residing in US currently can apply for stamping in any Consulate. Delhi. mumbai, Chennai or kolkata

Hey guys, I was wondering what program you guys use to view RAW files from your Sony (Alpha 200 in my case)?
I am particularly interested in a viewer where I can scroll throw a folder of images quickly full scree, using the arrow keys on the keyboard, possibly with an option to zoom in 100% and also possibly where I can easily delete the image with a press of the Delete button. You guys know of any freebie utility viewer like that? I tried MaxView from Faststone but it does not seem to display the pic in high quality. Thanks.

I know this issue is still a grey area and certainly no one seems to know a concrete answer to this.
If i have my H-1 Visa and EAD as well. Can i continue to Work on my H1-visa for the primary employer and take up a part-time job with the EAD.
I have hear ppl say that H1 becomes void once EAD is used. Is there any kind of document advocating this? I have not seen any. Lawyers have conflicting opinoin. Has anyone thought about this. I have decided to take an infopass appointment and ask the IO to show me a document that states that H1-becomes void or The other way around.
Can anyone shed more light in to this. Thanks

I applied for my concurrent filing during the July 07 fiasco. My I-140 is still pending approval. I am hoping that it gets approved within the next month or so...my question is ...when can I switch companies for a same/similar job if I wanted to? Since my I 485 has been pending for over 180 days do I need to wait for my I-140 approval? if I do have to wait, can I switch as soon as I get my 140 approval?

How many weeks of all possible unpaid leave can i avail while on EAD ?

Guys,
I have been reading some posts since yesterday. I still haven't been able to get a confirmed clarification.
If I am on H1, and change my status on H4 for lets say 8 months. Then decide to start working again on H1, would I be counted against the cap again?
I have been reading some posts which says if I have been counted against the cap once in last 6 years, I won't be counted again. Does that apply when one changes visa status from H1 to H4, and then back to H1.
Has anybody done this successfully. Can you point to some clarification or law from USCIS itself?

PERM (labor certification) process is a requirement from the DOL and has to be fulfilled by the employer. The employer will have to bear the costs of this first step in GC which includes (filing fees, recruitment process, lawyer fees etc). It is illegal for an employer to seek this compensation from the employee. Expenses incurred in I-140 and I-485 need not be compensated by the employer.
In your case, it seems that the employer is ready to help you with all the documentation but is not ready to bear the expenses. You will have to explain to your employer how the GC Process works and the requirements of the PERM process.

I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.
