In compliance with the precautionary measures and the travel health warning issued by the Department of State, the U.S. Consulate in Ciudad Juarez is canceling all immigrant visa and waiver appointments from April 30, 2009, through May 8, 2009. Individuals with immigrant visa appointments scheduled during this time will receive a letter with the rescheduled appointment date. Individuals with a scheduled waiver appointment will be contacted via e-mail or phone regarding the rescheduling.
Additionally, appointments for non-immigrant visas that were scheduled between April 29, 2009, through May 5, 2009, will be rescheduled. Hi,
Firstly, I would like to apologize for my ignorance & starting a new thread on this topic. I have some questions on porting & hopefully you learned people would help me on this.
1. When is the actual PD porting done? Is it done at I-140 stage?
2. I have I-485 filed in EB3-I. Now, I do my labor in EB2 & then at the time of applying I-140 do I tell USCIS that I have an old EB3 with PD of Nov 2004?
3. Say I do that, will USCIS automatically change my category on my pending I-485?
4. When I filed my I-485 in EB3, I was single. Now I am married. If USCIS automatically adjudicates my pending application, I believe, I will be in soup since my wife is not included in that. So should I (or the attorney) tell them NOT to adjust category on my pending I-485 instead I file a new I-485 under EB2?

All,
I wonder if more of you have noticed this phenomena: one of your applications gets approved, but the approval doesn't show up on the online case status system.
My AP was approved on Sept 17, 2007 and mailed out to my attorney who got it in a few days and told me about yesterday when I emailed about another issue. Oddly enough, even today (Sept 27), the online case status system shows an LUD of Sept 14 but no approval. I didn't get the usual approval email from the case status system either.
Annoying -- since now I won't learn of new developments till my lawyer calls me up to let me know and you know what slackers they can be. Although all this may be moot since apparently I am stuck waiting for my name check to clear, so there won't be any new developments to look look forward to for a long long time. Sigh. :(

I am also in the same situation that my company's attorney is not giving me I140 receipt number. They just say that it was filed in first week May but don't have the receipt number yet.

I really need advise. I am with Company A on H1, they filed my H1 extension 2 months ago (did not get approval yet) and they filed my I-140/485/EAD/AP(180 will be finishing after 90 days) and now I got following RFE on I-140. My lawyer has not replied yet.
Meanwhile the client where I am working has offered me full time position. Can I join this client on H1 and ask my current employer to continue my GC process and send AC21 on H1 after 180 days?
"The Master of Science Degree does not appear to be equivalent to U.S. Master Degree. Do NOT send an additional "education evaluations" that are mere advisory opinion. Submit preponderance of evidence that the beneficiary's bachelor and the master degree is U.S. equivalent based on educational records only"

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.
I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.
So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!
They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.
Please advise! is this something I should be feareful of?

WASHINGTON, June 13 � President Bush had barely left the Capitol after immigration talks there on Tuesday when Senator Harry Reid of Nevada, the majority leader, walked onto the Senate floor to call for a moment of silence. It was time, Mr. Reid said, to pay tribute to American soldiers in Iraq as their death toll reached 3,500.
A short time earlier, Mr. Reid convened a conference call with liberal bloggers, offering assurances that Democrats would revive debate over the Iraq war. And he pledged to revive it soon, ending the silence that followed the White House�s outmaneuvering of Democrats last month to win more money for the war without a timeline to end it.
�They�ve been driving this debate very well,� Mr. Reid said later, speaking of the bloggers who have been pushing for Congress to end the war. �I understand their disappointment. We raised the bar too high.�
It has been nearly three weeks since Democrats have held a formal Iraq debate or voted on an Iraq proposal in the House or Senate. Not since they assumed the majority in January has there been such a lull. During the three weeks, Congressional approval ratings have fallen, and Speaker Nancy Pelosi said she knew why.
�It�s the war, I believe so, it�s the war,� Ms. Pelosi said in a brief interview on Wednesday. �In terms of the issue that the American people want to have resolved, the war is three or four times higher than any other issue.�
Some Democrats argue that it is high time for the party to turn its attention to domestic issues � energy legislation, immigration overhaul and lobbying reform � to allay concerns that Democrats have not achieved enough significant accomplishments during the first six months of their majority. But other Democrats are demanding a return to the Iraq debate, which Mr. Reid has now pledged to do this month.
The proposals will not be new. Rather, Democrats intend to reprise at least four ideas when the Senate considers the Defense Department policy bill: a measure to reverse the authorization for the Iraq war, set a deadline for troop withdrawal, block money for major combat operations after March 31, 2008, and increase readiness requirements for troops to be sent back to Iraq. �On Iraq,� Mr. Reid said, �we�re going to hold the president�s feet to the fire.�
Democratic Congressional leaders have been stung by the decline in Congressional job approval ratings.
A Los Angeles Times/Bloomberg nationwide telephone poll released this week found that 27 percent of Americans approve of the way Congress is handling its job, while 65 percent disapprove. And 29 percent of the more than 1,100 poll respondents, all registered voters, said Democrats were working to change how government is run, compared to 63 percent who said Democrats are governing in a business-as-usual manner. The margin of error was plus or minus four percentage points.
Ms. Pelosi said it had been difficult to convince some Democrats that despite their majority, they are limited in how they can change the president�s Iraq policy.
�Some Democrats understand that we don�t have the signature and we can only do so much,� she said. �Others are just very unhappy. I include myself among them, being very unhappy that we have not been able to bring the war to an end.�
With September being highlighted as a critical review period for Iraq policy � Gen. David H. Petraeus, the top American commander, is to report to Congress on the progress of the current troop buildup � Democratic leaders had initially hoped to tackle their domestic priorities in late spring and early summer. But on Wednesday, Democratic leaders said they would not wait.
�The American people cannot and should not have to wait until later this year for changes in your flawed Iraq policy,� Ms. Pelosi and Mr. Reid wrote Wednesday in a letter to the White House.
Representative Rahm Emanuel of Illinois, the chairman of the Democratic conference, said Democrats could not be drawn into focusing solely on Iraq. �We have to do Iraq and change the priorities of Washington,� he said. �You can�t become a one-trick pony.�
The war has been the underlying theme of the new Democratic Congress, with barely a week going by without legislators embroiling themselves in committee hearings, a floor debate or symbolic resolutions for and against the war. Democrats have walked a careful line, trying to keep their criticism alive, but lowering expectations that they alone can influence war policy.
The month of June, though, has so far unfolded with barely a word being uttered about Iraq. And lawmakers said they were hearing about it.
Senator Amy Klobuchar, a Minnesota Democrat who was elected last fall, said constituents were seeking reassurance that Democratic efforts to challenge the administration have not fallen off. She said voters had little interest in being schooled in the intricate rules of the Senate, where 60 votes are required for debate to proceed on legislation.
�I share their frustration, answering them with procedural answers, �Well, we need 60 votes,� � she said. �People are dying over there, so that isn�t always helpful.�
While Congress must accomplish domestic priorities, she said, Iraq remains the chief issue for most voters. �I think that�s one of the things we�ve struggled with, is finding that balance,� she said, welcoming the news that the Senate intends to revive the debate before month�s end. �It�s very important to me. I don�t want to go home until we do it.�

I heard that there was a deadline to send 45 day letter before end of June this year. And I have seen 45 day letters coming to my friends and me.
Question is: Is there any deadline for them to complete processing all cases???
Another concern. When they are done processing all 350K cases, think of retrogression!

Friends - anyone here who has applied in PERM where job required B.S + 2 - 4 yrs of experience? Mine is a Job zone 4(sr. software engineer), requires B.S + 30 months and in the PERM form the lawyer has entered 'No' to H12 question 'Is this normal requirements'. Were they right? Or should I be worried? Anybody can share any experience? Thanks!

Our problems cannot be solved by one party alone - whether they have the majority or not! There are too many interested (opposing) parties. It does not matter which party gets the control, unless we have bipartisanship on our issues. We, as the affected group needs to do everything we can to get the congressmen to reach across the aisle..........

OK, the hiatus of Immigrant of the Day is officially over. Send me your suggestions and I look forward to highlighting the accomplishments of immigrants contributing to America in many ways. Congrats to Mexican-born Ignacia Moya who at 106 years old has become a naturalized American. She immigrated to the US nearly 40 years ago already in her 70s. Despite her blindness and deafness, Ms. Moya has persevered in seeking citizenship and is realizing her dream after nearly a quarter century of waiting. All of Ms. Moya's children, grandchildren and great-children are in the US including her great-grandson George Bojorquez,...

If we're thinking of the same thing, the cover letter basically is a simple letter that explains what is in the package and what is the purpose of the package/envelope/application. It enumerates all the documents enclosed, almost like a checklist. You don't have to enclose it but it'd be good to do so not just for you but also for the person opening your package so they know if you enclosed something that they're looking for. It kind of keeps the whole thing organized.
